THE FYLDE BOROUGH (OFF-STREET PARKING PLACES) (CONSOLIDATION) ORDER 2007 – AMENDMENT ORDER NO. 5 (2021)

Fylde Borough Council in exercise of its powers conferred on it by sections 32, 33 and 35 of the Road Traffic Regulation Act 1984 and of all other enabling powers and with the consent of the Lancashire County Council in accordance with section 39 of the said Act and after consultation with the Chief Officer of Police in accordance with paragraph 20 to Schedule 9 to the said Act, hereby make the following Order to the effect that:-

The Fylde Borough (Off-Street Parking Places) (Consolidation) Order 2007 (the 2007 Order) shall be amended as follows:

Schedule 1:

a. The plans attached to this Order and showing the designated areas for overnight stays by motorhomes shown hatched in black on the plans shall be substituted for plans numbered 1, 3, 5 and 18 attached to the 2007 Order;
b. The provisions of Schedule 1 of the 2007 Order as they relate to motorhomes on North Promenade Car Park, St Paul’s Avenue Car Park, St Annes Swimming Pool Car Park, North Beach Car Park and coaches on Fairhaven Road Car Park shall be deleted and replaced with the following:

Maximum length of vehicle Notice of Proposals 6 meters
Draft Order. 8 meters


St Paul’s Avenue Car Park

Charges Up to 1 day (24hr) £10.00
1 to 2 days (24 to 48 hrs) £15.00

Maximum Stay 48 hours, no return within 4 days

STATEMENT OF REASONS

In accordance with its general function of providing off-street parking (and its ongoing responsibility to review such arrangements) within the Borough and pursuant to Fylde Borough Council’s powers under Sections 32, 33 and 35 of the Road Traffic Regulation Act 1984, the Council is proposing to make the above Amendment Order for the purposes of addressing current off-street parking requirements in relation to its car park at North Promenade, St Paul’s Avenue, St Annes Swimming Pool, North Beach and Fairhaven Road, Lytham St Annes. This includes managing the number of motorhomes that park overnight on the lower section of St Annes Swimming Pool Car Park by displacing some users onto alternative locations.

This Statement is to be read in conjunction with the Notice of Proposals and the draft Order.

message: Whilst being allowed to park our motorhomes overnight in St Paul's Avenue car park, and obeying the Forbidden Actions, are we allowed to 'sleep' in our motorhomes when they are parked overnight. ?

Thank you for this reply.

Whilst a lot of Councils post up on their website, and car park signage, that motorhomes can 'park overnight', a lot of their TRO's state 'sleeping/camping' is not allowed.

This is a big issue of contention within the motorhome community, and is forever appearing on their Facebook group pages, as we are 'Parking up overnight', without the implications of camping. (no setting out of tables, seats, cooking facilities)

I read the Council's Traffic Orders on the website, and noticed on the documents published for the Amendment Order Consultation ending 22 July 21, some conflicting information between the Notice of Proposals and the Draft Order, for two of the four Car parks allowing Motorhomes to park overnight, regarding Maximum Length of Motorhomes, as follows;

North Promenade. Car Park:
Notice of Proposal 6m..
Draft Order 8m.

St Paul's Avenue Car Park
Notice of Proposal 5m.
Draft Order 10m.

St Anne's swimming Pool Car Park
Notice of Proposal 8m
Draft Order 8m (reduced from current 10m length).

North Beach Car Park is being kept at the current 10m length.

A lot of owners were surprised to see the 5m length for St Paul's Avenue, as most motorhomes are 6 meters+ in length. Campervans would be more likely to be 5m max as they are as long as a car.

Presumably, it will be the lengths in the Draft Order, ( The provisions of this Order will take effect from 2021), that will be ratified at the next Full Council meeting on 18th October ?

So, North Promenade and St Paul's Avenue car parks are currently, off limits to the majority
of motorhomes on the road, as they are not less than 7m in length, until the new Draft Order has been ratified.
